Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the service (the “Service”) provided by Passeig Studio (“we,” “us,” or “Passeig Studio”) at passeigstudio.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1.The Service
The Service is a software platform that generates short-form videos and, with your authorization, publishes them to your connected social media accounts and reports on their performance. We may add, change, or remove features at any time.
2.Eligibility
You must be at least 18 years old and able to enter into a binding contract to use the Service.
3.Your account
You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.
4.Connected social accounts
When you connect a YouTube, Instagram, or TikTok account, you authorize us to act on your behalf — to publish content you direct us to publish and to retrieve performance data — through that platform’s official authorization. You remain responsible for complying with the terms, policies, and community guidelines of each platform you connect, including any requirements to disclose or label AI-generated content. You can disconnect any account at any time. We are not responsible for any action a platform takes against your account, including limiting, suspending, or terminating it.
5.Your content and review responsibility
As between you and us, you own the content you provide and the videos generated for you through the Service. You grant us a limited license to host, process, modify, and transmit that content as needed to operate the Service and to publish it to the accounts you connect. The Service uses automated and AI-based tools to generate content. You are responsible for reviewing and approving content before it is published, and for ensuring it is accurate, lawful, and appropriate for your audience and for each platform. You are solely responsible for the content published to your accounts.
6.AI-generated content
Content produced by the Service is generated by automated systems and may be inaccurate, incomplete, or unsuitable without review. We make no representation that generated content is accurate or fit for any particular purpose. Stock footage and other third-party assets are provided under their respective licenses (for example, the Pexels license).
7.Acceptable use
You agree not to use the Service to create or distribute content that is illegal, infringing, deceptive, harassing, or that violates any third party’s rights or any platform’s rules. You agree not to misuse, interfere with, reverse-engineer, or attempt to gain unauthorized access to the Service.
8.Subscriptions and billing
Paid plans are billed in advance through our payment processor (Stripe) on a recurring basis (monthly or annual) and renew automatically until cancelled. You can cancel at any time, effective at the end of the current billing period. Fees are non-refundable except where required by law. We may change pricing with reasonable notice; changes take effect at your next renewal.
9.Intellectual property
The Service, including its software, design, and content (excluding your content), is owned by Passeig Studio and protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service.
10.Third-party services
The Service relies on third-party providers (including those listed in our Privacy Policy) and on the social platforms you connect. We are not responsible for those third parties, their availability, or their actions.
11.Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee any particular results, including views, engagement, follower growth, monetization, or that published content will be accepted or retained by any platform.
12.Limitation of liability
To the maximum extent permitted by law, Passeig Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
13.Indemnification
You agree to indemnify and hold harmless Passeig Studio from any claims, losses, or expenses arising out of your content, your use of the Service, or your violation of these Terms or any platform’s rules.
14.Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.
15.Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, where appropriate, notify you. Continued use after changes take effect constitutes acceptance.
16.Governing law
These Terms are governed by the laws of the State in which Passeig Studio is established, without regard to its conflict-of-laws rules.
